Breaking News: Legal Win for Edo State Government: Court Vacates Mandatory Order on Local Government Councils

In a significant legal development for the Edo State Government, an Edo State High Court, presided over by Honorable Justice Efe Ikponmwoba, has set aside a mandatory injunction previously issued against the government and its officials. The ruling, which took place on February 17, 2025, arose from a suit filed by Oluwole Osaze Uzzi Esq, the immediate past Attorney General of Edo State, on behalf of the 18 Local Government Councils in the state, as well as the Association of Local Governments of Nigeria (ALGON).

The court's decision comes as a relief to Governor Monday Okpebholo and his administration, allowing for the restoration of a smoothly functioning local government system that adheres to the democratic structures that govern municipalities in Edo State. This follows a contentious period marked by the suspension of 18 Local Government Council chairmen, who were accused of financial infractions by an administrative panel of inquiry and subsequently removed from office by the Edo State House of Assembly on December 16, 2024.

The legal stance initiated by the suspended council chairmen, who sought interim and mandatory injunctions against their suspension, was initially favored by the court on December 20, 2024. However, in a subsequent motion filed by the current Attorney General of Edo State, and argued by learned Senior Advocate K. O. Obamogie SAN, the government contested the validity of the earlier order, leading to today’s bench ruling.

This latest court ruling signifies more than just a legal victory for the Edo State Government. It also paves the way for the ongoing investigations into the financial activities of the suspended chairmen, which will continue under the purview of the Economic and Financial Crimes Commission (EFCC). The EFCC’s involvement indicates a serious commitment to ensuring accountability and transparency within local government operations, reinforcing the state’s intention to rectify any malpractices and safeguard public funds.

While commenting on the ruling, Governor Okpebholo expressed optimism about the future of local governance in Edo State. He stated, “Today’s ruling marks a new chapter for our local government councils. We are committed to working with democratically elected officials to enhance governance and development at the grassroots level.”
